POLICY FOR THE TREATMENT OF INFORMATION – PERSONAL DATA
In compliance with the provisions granted in Article 13 of Decree No. 1377, regulating the Enacting Law for Protection of Personal Data, No. 1581 of 2012, the companiesMAC® - JOHNSON CONTROLS COLOMBIA, S.A.S. – NIT 900.388.600-1 y MAC® DEL PACIFICO S.A.S. – NIT 817.000.727-1, business companies located in the Municipalities of Yumbo (Valle del Cauca) and Villa Rica (Cauca), respectively, would like to disclose their policy regarding the treatment of MAC®Information - personal data for the knowledge of their members and the public in general.
TREATMENT: The treatment that the companies offer and will continue to offer regarding personal data on collection, storage, use, circulation, up-dating or removal of same, whose main objective is to reach an efficient communication and business relationship with our customers and suppliers regarding: our products, services, promotions, advertising, alliances, etc., requirements for supplies and services; provide our products and/or services, MAC®Information on new products and/or services, to comply with all the obligations contracted with our customers, suppliers and partners; report changes regarding our products and/or services as well as corporate changes; evaluate the quality of our products and/or services and of our suppliers; maintain the MAC® Information data updated regarding our customers and suppliers, so that the final product is solely and exclusively commercial and work related in the case of the exployees, as well as the for the report which is presented to the control and monitoring authorities, where it is necessary to do so.
RIGHTS OF TITLEHOLDERS OF PERSONAL DATA: Considering the stated regulations, the Titleholders of the personal data have the following rights contained in Article 8 of Law 1582 of 2012:
“Article 8. Rights of Titleholders.The Titleholders of the personal data will have the following rights:
a) To understand, update and rectify their personal data before the responsible individuals or the Titlehodlers.These rights may be enforced, among others, before inaccurate, incomplete, and split and/or partial data, those which could infer mistakes, or those whose treatment is expressly prohibited or which have not been authorized;
b) May request proof of the authorization granted by the individual who is Responsible for the Treatment , except when it has been expressly excluded as a requirement for the Treatment, in accordance with the provisions of Article 10 of this Law;
c) Be informed by the person who is Responsible for the Treatment, upon prior request, regarding the use given to his personal data;
d) Submit to the Superintendence of Industry and Commerce any and all complaints of any violations regarding the provisions of this law and of any other regulations that modify, and/or supplement same;
e) Revoke the authorization and/or request the deletion of the data when the principals, as well as the constitutional and legal rights and guarantees, are not respected. The revocation and/or suppression will go forward when the Superintendence of Industry and Commerce has determined that the Treatment given by the individual who is Responsible or Delegate has engaged in conducts that are contrary to this law and the Constitution.
f) Freely acceed to their personal data which has been the subject of the Treatment. ”
The foregoing is without prejudice to any other rights enshrined in the Law Annotated 1581, 2012, Decree No. 1377 of 2013 and other related standard regulations.
RESPONSIBLE AREA:Within the MAC® - JOHNSON CONTROLS COLOMBIA, S.A.S. and MAC® DEL PACIFICO S.A.S., the area of responsibility for the management of personal data will be the Security Committee of MAC® Information, and the contact person is Luis Fernando González, electronic mail: email@example.com, telephone (2) 684-5107, who will respond to questions, petitions and claims that are made by the titleholders, who may present their requests regarding their rights to update, rectify and/or delete whatever data available and who may also revoque the authorization previously given.
a) Once the communication or email is received from the Titleholder of the data, the process to follow will be completed within a period of five (5) working days.
b) Once the above has been fulfilled, MAC® - JOHNSON CONTROLS COLOMBIA, S.A.S. and/or MAC® DEL PACIFICO S.A.S. will notify the individual regarding the answer to their application or request via e-mail, within five (5) working days following the expiration of the period stipulated in paragraph a), certifying compliance with the request regarding the update, rectification or deletion of the data, or the revocation of the authorization, as appropriate.
This actual policy of MAC®Information Treatment has been enforced according to the requirements contained in the above mentioned standards.
The database described will be in force as long as the companies of MAC® - JOHNSON CONTROLS COLOMBIA, S.A.S. and MAC® DEL PACIFICO S.A.S. are also valid.
